Terms and Conditions (“T&Cs”)


1. Purpose

1.1 The purpose of these T&Cs is to set out the conditions on which PayStream will pay a Reward to the Referrer in circumstances where the Referrer refers an individual (the “Referred”) to PayStream’s accounting services or a PayStream Umbrella Company. Payment of the Reward is at PayStream’s absolute discretion and we may revoke or amend this Scheme at any time without notice.

2. Definitions

2.1 The terminology used in the T&Cs shall unless stated otherwise have the following meaning:

PayStream: means PayStream Accounting Services Limited.

PayStream Umbrella Company: means any of the following: PayStream My Max Limited, PayStream My Max 2 Limited or PayStream My Max 3 Limited.

Referrer: means an individual that meets the eligibility criteria below and refers the Referred to PayStream.

Referred: means an individual that meets the eligibility criteria below and has been referred by the Referrer to PayStream.

3. The Scheme

3.1 The Scheme is run by PayStream and is available to any existing PayStream accounting client, or any individual engaged with or employed by PayStream Umbrella Company subject to meeting the eligibility criteria set out below.

3.2 Subject to eligibility, if the Referrer refers the Referred to any of the following:

PayStream’s accountancy services; or

My Max: employment by a PayStream Umbrella Company.

the Referrer shall be entitled to receive a Reward (“Reward”) in accordance with these T&Cs.

4. Eligibility

4.1 To be eligible for the Reward under the Scheme:

4.1.1 The Referred must confirm to PayStream during the initial consultation that he/she was referred to PayStream by the Referrer AND a written communication containing contact details for the referred must be sent to PayStream by the Referrer via the 'Refer' page of the PayStream website, the 'Referrals' tab of our accounting software, Insight, or via email to new.business@paystream.co.uk. For the avoidance of doubt, initial consultations are undertaken by PayStream’s New Business team and are accompanied by an illustration of take home pay; AND

4.1.2 The referral must not fall within the Specific Exclusions in clause 5 below. Please note that PayStream’s opinion on whether the referral falls within a Specific Exclusion shall be final; AND

4.1.3 The following conditions are also met:

4.1.3.1 In respect of the Referred, the Referred must not have been employed by a PayStream Umbrella Company or engaged the services of PayStream in the last 2 years prior to the commencement of this Scheme and the Referred must be, either:

  • Currently employed by a PayStream Umbrella Company and if the Referred is weekly paid, has been paid in respect of four pay reference periods AND the PayStream Umbrella Company shall have received four weekly margins with regards to those pay reference periods; or
  • Currently employed by a PayStream Umbrella Company and if the Referred is monthly paid, has been paid in respect of a month pay reference period AND the PayStream Umbrella Company shall have received a monthly margin with regards to that pay reference period; or

[Accounting]

  • Have commenced an engagement for accountancy services with PayStream.

AND:

4.1.3.2 In respect of the Referrer, the Referrer must be, either:

  • Currently employed or engaged by a PayStream Umbrella Company and if the Referrer is weekly paid, have been paid in the last pay reference period. In order for PayStream to pay the Reward, the Referrer must also have a pending payment due; or
  • Currently employed by a PayStream Umbrella Company and if the Referrer is monthly paid, have been paid in the last monthly pay reference period. In order for PayStream to pay the Reward, the Referrer must also have a pending payment due; or

[Accounting]

  • Currently engages PayStream’s accountancy services and is up-to-date in the payment of PayStream’s accountancy fees

5. Specific exclusions:

5.1 Where any of the following apply, no Reward shall be payable by PayStream under or in connection with the Scheme:

5.1.1 The Referrer has referred the Referred to the Scheme on another or separate occasion. For the avoidance of doubt, the Referrer can only refer the Referred once to the Scheme.

5.1.2 A recruitment business or any other third party (including an individual) has referred the Referred to PayStream.

5.2 We exclude Reward payments under the Scheme where services are provided to the clients of certain recruitment businesses. This is at PayStream’s absolute discretion.

5.3 The Scheme is available only to persons who can form legally binding contracts under English law. Without prejudice to the foregoing, the Scheme is not available to individuals under the age of 18.

6. Reward

6.1 Subject to clauses 3, 4 and 5 above, the Reward available to the Referrer is

7. Payment of the Reward

7.1 PayStream reserves the right to determine when to make payment of the Reward.

7.2 Only one Reward can be claimed by the Referrer.

7.3 No cash alternatives will be in place of the Reward and Rewards cannot be changed from the description contained in clause 6.

7.4 Where the Referrer has engaged PayStream's accountancy services, the Reward will be paid into the Referrer’s company bank account.

7.5 Where the Referrer is employed or engaged by a PayStream Umbrella Company, the Reward will be processed through the Referrer’s payslip.

8. Data Protection

8.1 The Referrer will obtain the consent of the Referred for their contact details to be passed to PayStream. Upon receipt of the contact details, PayStream will have a legitimate interest to process the information of the Referred. PayStream shall use the information received from the Referrer to promote its Scheme, PayStream Umbrella Company and service information by e-mail, SMS or phone. The Referred has the right to object to marketing from PayStream by contacting marketing@paystream.co.uk. For more detail on how PayStream will use information please refer to our Privacy Notice.

9. Complaints or Dispute

9.1 In the event of any dispute or complaint raised by the Referrer or the Referred, it should in the first instance be raised with the Marketing Department, Mansion House, Manchester Road, Altrincham, WA14 4RW. PayStream will use all reasonable endeavours to deal with the complaints/dispute within 10 Working Days.

10. Notifications

10.1 Any general notices or communications in accordance with the T&Cs may be sent by email and shall be deemed to have been received at the time the email was sent (if on a working day) subject to confirmation of receipt and if sent any time after 4.30pm on a working Day shall be deemed to have been received at 9.30pm on the following working day. A working day for the purpose of these T&Cs shall mean Monday to Friday, inclusive but excluding bank holidays in England.

10.2 Any legal proceedings must be sent by First Class Post and shall be deemed received 2 working days after posting. Service by email will not be accepted.

11. Third Party Rights

11.1 No party other than PayStream, the Referred or the Referrer will have any rights under the T&Cs.

12. Liability

12.1 PayStream reserves the right to alter, amend or foreclose the Scheme without prior notice or liability. Any Referrer or Referred who qualifies for the Scheme agrees to indemnify and hold PayStream harmless against all actions, claims, demands, liabilities, losses, damages, costs and expenses of whatever nature that may result or which PayStream may sustain, suffer or incur as a result of PayStream agreeing to provide the Scheme to the Referrer and the Referred.

13. Variation

13.1 PayStream shall have the right to vary the T&Cs at any time and the Scheme will only apply at the discretion of PayStream. PayStream reserves the right to withdraw and/or amend the Scheme as appropriate. The Scheme cannot be used in conjunction with any other Scheme of promotion.

14. Entire Agreement

14.1 These Terms constitute the entire agreement between the parties and will supersede and extinguish any previous agreements, assurances, warranties and representations and any understandings between the parties, whether written or oral relating to the Scheme.

15. Governing Law and Restriction

15.1 Any dispute or claim arising out of or in connection with the Scheme shall be governed in accordance with English Law and the parties shall irrevocably submit to the exclusive jurisdiction of the Courts of England.

16. Declaration

16.1 By entering the Scheme, the Referrer and Referred confirm receipt, understanding and acceptance of these T&Cs.
